Terms of Service

These terms govern access to and use of the AiMatchWise platform. They set out what we provide, what customers are responsible for when screening candidates with AI, and the limits of the platform's output.


1. Agreement

These Terms of Service govern your access to and use of the AiMatchWise platform, operated by AIMATCHWISE TECHNOLOGIES PRIVATE LIMITED (CIN U62011KA2026PTC214313), No 706, Wing 4, 7th Floor, GK Tropical Springs, Channasandra Main Road, Thirumalashettyhally, Koralur, Bangalore Rural, Karnataka 560067, India.

By creating an account, signing in, or otherwise using the platform, you agree to these terms. If you are accepting on behalf of an organisation, you confirm that you have authority to bind that organisation.

If you do not agree, do not use the platform.

2. Definitions

  • "Customer" means the organisation that holds an account on the platform.
  • "Authorised User" means a person the Customer permits to access the platform under its account, such as a recruiter, hiring manager, or administrator.
  • "Candidate" means a person invited by a Customer to take a screening interview.
  • "Interview Data" means job descriptions, interview plans, résumé text, transcripts, proctoring signals, and scorecards processed through the platform.

3. Accounts and access

You must provide accurate registration details and keep your credentials confidential. You are responsible for activity under your account and must notify us promptly of any unauthorised use.

Access within an organisation is governed by roles — organisation owner, recruiting manager, recruiter, interviewer, and candidate — each carrying different permissions. The Customer is responsible for assigning roles appropriately and for removing access when someone leaves.

Accounts are for named individuals. Do not share logins.

4. Plans, limits, and fees

Access is provided under a plan. A plan may cap the number of interviews per month, the number of members in an organisation, and the number of concurrently active screenings; an unset cap means unlimited. Usage is metered, and we may prevent actions that would exceed your plan's limits.

Fees, billing frequency, and currency are those stated for your plan at the time of purchase. Unless stated otherwise, fees are exclusive of applicable taxes, which you are responsible for. We may change pricing on reasonable notice, effective from your next billing period.

5. Customer responsibilities

These obligations are central to using an AI screening tool lawfully, and the Customer accepts them as a condition of access:

  • Use the platform only for legitimate employment screening, and comply with all applicable employment, anti-discrimination, and data protection laws in every jurisdiction where you recruit.
  • Provide candidates with any notice required by law, and ensure you have a lawful basis for processing their personal data before inviting them.
  • Ensure a competent human reviews the platform's output before any hiring or adverse decision is taken. Scorecards are advisory and must not be the sole basis of a decision about a person.
  • Do not use the platform to assess or infer protected characteristics, health, or any attribute unrelated to the role.
  • Ensure you have the right to upload any résumé, job description, or other content you submit.
  • Respond to candidate requests concerning their own data, for which you act as controller.

6. Acceptable use

You must not:

  • Attempt to gain unauthorised access to the platform, another organisation's data, or any underlying system.
  • Reverse engineer, scrape, or resell the platform, or use it to build a competing product.
  • Upload malware, or content that is unlawful, defamatory, or infringes another party's rights.
  • Interfere with the platform's operation, circumvent rate limits or plan limits, or misrepresent a candidate's identity.
  • Use the platform to conduct interviews without disclosing to the candidate that they are being interviewed and assessed by an AI system.

7. AI-generated output and its limits

Interview plans, interview turns, and scorecards are produced by large language models. They can be incomplete, mistaken, or inconsistent, and transcripts are generated by automatic speech recognition and will contain errors.

The platform includes safeguards: every scored claim must cite a verbatim quotation from the transcript, citations are machine-verified against the stored transcript, and scorecards that fail those checks — or that show low confidence, uncovered topics, or thin evidence — are flagged for mandatory human review.

Those safeguards reduce risk; they do not eliminate it. We make no warranty that a scorecard is accurate, complete, or predictive of job performance, and you must not treat it as a substitute for human judgement.

8. Interview monitoring

Where a Customer enables monitoring, the platform records assessment-integrity signals and may store still images captured during the interview, as described in our Privacy Policy. The resulting integrity score reflects assessment conditions only and is not a measure of a candidate's ability.

The Customer is responsible for deciding whether monitoring is appropriate and lawful for its recruitment process, and for handling any candidate who requests an alternative. Candidates are shown a disclosure and must acknowledge it before a monitored interview begins.

9. Platform administration

Our platform administrators may access an organisation's account where necessary to provide support, investigate a fault, or comply with law. Such access, including any session where an administrator acts within a Customer's workspace, is recorded and distinguishable in our audit records.

10. Intellectual property

We retain all rights in the platform, including its software, interview rubric, and interface. These terms grant you a limited, non-exclusive, non-transferable right to use the platform during your subscription.

You retain all rights in your own content and Interview Data. You grant us a licence to host, process, and transmit that content solely to provide and support the platform.

Feedback you send us may be used to improve the product without obligation to you.

11. Confidentiality

Each party may receive confidential information from the other. The receiving party will use it only to perform under these terms, protect it with at least reasonable care, and not disclose it except to personnel and service providers bound by comparable obligations, or where legally compelled.

12. Suspension and termination

You may stop using the platform at any time. We may suspend or terminate access where an account breaches these terms, poses a security or legal risk, or has unpaid fees, and we will give reasonable notice where circumstances allow.

On termination, your right to use the platform ends. Data is handled in accordance with our Privacy Policy; contact us before termination if you need an export.

13. Disclaimers

Except as expressly stated, the platform is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, and we are not responsible for the availability of third-party services the platform depends on.

14. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or anticipated savings.

Our total aggregate liability arising out of or relating to the platform is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or death or personal injury caused by negligence.

15. Indemnity

You will indemnify and hold us harmless against claims, losses, and reasonable costs arising from your use of the platform in breach of these terms or applicable law, including any claim by a candidate concerning a hiring decision you made or the notice and consent you were responsible for obtaining.

16. Governing law

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute, without prejudice to either party's right to seek interim relief elsewhere.

17. Changes to these terms

We may update these terms as the product and the law evolve. The revision date at the top of this page reflects the current version, and we will give account holders notice of material changes. Continuing to use the platform after a change takes effect constitutes acceptance.
